NOTICE OF FORECLOSURE SALE UNDER DEED OF TRUST
As recorded in Deed Book RB 1022, Page 383
Under the virtue of an order of the Clerk of Superior Court of Bertie County, entered in this action authorizing the undersigned to proceed with the foreclosure of the above-referenced Deed of Trust, the undersigned Trustee will offer for sale at public auction to the highest bidder for cash at 1:00 a.m. on October 10, 2024 in Bertie County, North Carolina, the following described property:
The parcel of land together with improvements thereon in “as is” condition situated in the Town of Lewiston, Woodville Township, Bertie County, North Carolina, described more particularly as follows:
Lot #2: All that certain lot or parcel containing
0.465 acre, more or less, on the Southeast side of Main Street and the Southwest side of Marianna Street in the Town of Lewiston, Bertie County, North Carolina, and being more particularly described as follows: BEGINNING at an existing iron stake set at the point of intersection of the Southeast edge of the public right of way of SR 1145 (Main Street) with the Southwest edge of the 50 feet right of way of Marianna Street; and running thence along the Southwest edge of the right of way of Marianna Street South 48 degrees 02 minutes 40 seconds East
130.00 feet to a new iron stake, a corner; thence along a lot owned by Riddick designated as Lot #1 South 41 degrees 51 minutes 30 seconds West
156.00 feet to a new iron stake, a corner for Lot #3; thence North 48 degrees 03 minutes 28 seconds West
130.00 feet to a new iron stake on the Southeast edge of the public right of way of SR 1145 (Main Street); thence along the Southeast edge of the right of way of Main Street North 41 degrees 51 minutes 30 seconds East
156.03 feet to the existing iron stake, the point of Beginning.

0.465 acre, more or less, on the Southeast side of Main Street in the Town of Lewiston, Bertie County, North Carolina, and being more particularly described as follows: BEGINNING at an existing iron stake set on the Southeast edge of the public right of way of SR 1145 (Main Street) and marking the Northeast corner of property of Wayne Williams as described in Deed in Book 602 Page 643, Bertie County Registry; thence along the Southeast edge of the right of way of Main Street North 41 degrees 51 minutes 330 seconds East
156.00 feet to a new iron stake, a corner for Lot # 2 as described above; thence South 48 degrees 03 minutes 28 seconds East
130.00 feet along the line of Lot # 2 to a new iron stake; thence South 41 degrees 51 minutes 30 seconds West
54.00 feet along the line of Lot # 1 to a new iron stake, a corner for Lot # 4, and thence South 41 degrees 51 minutes 30 seconds West
101.60 feet to a new iron stake, located at the line of property of Rick Mitchell; thence along the Rick Mitchell lot and Wayne Williams lot North 48 degrees 14 minutes 00 seconds West
130.00 feet to the existing iron stake, the point of Beginning.
The above descriptions are based upon a plat of survey entitled “PROPERTY OF RHYNDA RIDDICK & DIANESE RIDDICK” prepared by Linwood L. Rawls, Professional Land Surveyor, and the described lots are a portion of the property described in deed in Book 799, Page 990, Bertie County Registry. For further reference, see deed recorded in Book 834, Page 393, Bertie County Registry.
The conveyance is made together with and subject to legally enforceable easements, conditions, rights of way and restrictions of record or apparent on-site.
The property is commonly known as 403 Main Street, Lewiston-Woodville, NC 27849.
The above-described will be sold subject to ALL UNPAID TAXES, including unpaid county and city ad valorem taxes, including those for the year 2024, and also city assessments, if any. The buyer of the property shall be responsible for all taxes upon transfer, including excise tax and land transfer tax.
The record owner of the property as reflected on the records of the Register of Deeds’ office not more than ten (10) days prior to posting of this notice is Katrina D. Watson.
The highest bidder at the sale will be required to make a cash deposit of $
750.00 or five percent (5%) of the amount of the bid when knocked down to him, whichever is greater, and the balance upon confirmation of the sale.
The sale will be reported to the court and will remain open for advance or upset bids for a period of ten (10) days. If no advance or upset bids are filed with the Clerk of Superior Court, the sale will be confirmed.
Any person who occupies the property pursuant to a rental agreement entered into or renewed on or after October 1, 2007, may after receiving the notice of sale, terminate the rental agreement upon 10 days written notice to the landlord. Upon termination of a rental agreement, the tenant is liable for rent due under the rental agreement prorated to the effective date of the termination.
An order for possession of the property being sold may be issued pursuant to N.C.G.S. §
45-21.29 in favor of the purchaser and against the party or parties in possession, by the Clerk of Superior Court of the county in which the property is sold.
